Key Terms 

(a) Our liability: except in relation to our Non-Excludable Obligations, our breach of these Terms and our negligent acts or omissions, to the extent permitted by law, we are not liable to you for Loss arising under or in connection with these Terms (see clause 13).

(b) Termination/suspension: we may suspend or terminate your access to the Offer (and these Terms) in the circumstances set out in clause 8. If this happens, you may not be able to redeem the Offer.

  1. This Agreement

    1.1 These 7-Eleven Offer Terms and Conditions (Terms) apply between the customer who accepts the terms in accordance with clause 1.2 and meets the Eligibility Criteria in clause 3 (you, your) and EnergyAustralia Pty Ltd ABN 99 086 014 968 (EnergyAustralia, we, us, our). 

    1.2 By registering for or using My Account (which is required to log in to the App), logging into or using the App, or generating or using a Barcode in the App to redeem the Offer, you agree to be bound by these Terms.

  2. Overview and relationship to your energy supply contract

    2.1 These Terms apply to your participation in the Offer. The Offer is available only through the App. While you may register for My Account via our website or other channels, you must have an active My Account profile to log in to the App and access and redeem the Offer.

    2.2 Your electricity and/or gas supply to your premises is governed by your EnergyAustralia Retail Contract. These Terms are separate and do not change any prices, tariffs, charges, billing, payment or disconnection or any other rights and obligations under your EnergyAustralia Retail Contract.

    2.3 The Offer is a promotional benefit delivered through the App and does not form part of your EnergyAustralia Retail Contract unless we expressly state otherwise in writing.

    2.4 Your use of My Account and the App is also subject to our My Account and App terms and conditions published on the App and our website (Platform Terms) and should be read together with these Terms.

    2.5 Your eligibility for the Offer depends on you having an active EnergyAustralia Retail Contract. If your EnergyAustralia Retail Contract ends, you will no longer be eligible for the Offer (see clause 8.2(c)).

    2.6 If there is any inconsistency between these Terms and the Platform Terms, these Terms prevail to the extent of the inconsistency for the Offer.

  3. Eligibility

    3.1 To access and redeem the Offer, you must meet all of the following eligibility criteria
    (Eligibility Criteria):

    (a) you are an active EnergyAustralia electricity and/or gas customer (meaning you have an active EnergyAustralia Retail Contract at the time you redeem the Offer); and

    (b) you are registered as an EnergyAustralia My Account user and have authenticated access to the App.

    3.2 If you stop meeting any Eligibility Criteria, you may not be able to access or redeem the Offer and we may suspend or terminate these Terms in accordance with clause 8.

  4. Your My Account profile and the App access

    4.1 The Offer is accessed through the App. You access the App by logging in using your My Account profile. You must maintain your My Account profile and App access to generate a Barcode and redeem the Offer.

    4.2 You are responsible for the confidentiality and use of your login details and for activity carried out using your login details. If you suspect unauthorised use of your profile or login details, you should let us know as soon as you can.

    4.3 We may suspend or restrict access where we suspect unauthorised use or misuse of the App, Barcode, or your profile, including to protect the security of our systems or the integrity of the Offer.

  5. The Offer

    5.1 Subject to you meeting the Eligibility Criteria, you may receive 6 cents per litre off fuel when you generate and scan the relevant discount Barcode at the point of sale at fuel stores operated by 7-Eleven in Australia (7-Eleven Fuel Stores).

  6. Exclusions and limits

    6.1 The Offer is only available at 7-Eleven Fuel Stores. The Offer excludes LPG and AdBlue. 

    6.2 The Offer can be redeemed on one grade of fuel per transaction for a maximum of two transactions in any 24-hour period and only applies up to 100 litres of fuel per transaction. 

    6.3 The Offer cannot be used in conjunction with any other discounts or loyalty offers (including Fuel Price Lock or fuel card offers).

    6.4 The Offer will not apply where you scan your My 7-Eleven App in the transaction in circumstances where you have a valid Fuel Price Lock. 

    6.5 Where you have a valid Fuel Price Lock which is scanned in the same transaction, the Fuel Price Lock will be applied to the transaction irrespective of its value and the Offer will not be applied. 

    6.6 The Offer is not valid for transactions on fuel cards including Fleet Card, 7-Eleven Fuel Card, 7-Eleven Fuel Pass, WEX Motorpass or Motorcharge transactions.

    6.7 7‑Eleven does not operate fuel stores in all locations and does not warrant that all 7‑Eleven branded fuel sites will be operational at all times, or that all fuel types will be available at all sites.

  7. Redeeming the Offer (barcode rules)

    7.1 The Offer is only redeemable at the time of purchase, by scanning a valid Barcode through the App at the 7-Eleven Fuel Stores.

    7.2 Barcodes are valid for 30 minutes and should be generated in the App before dispensing fuel. 

    7.3 Any fuel dispensed without a valid barcode, or in circumstances where a valid barcode cannot be processed, will need to be purchased at the pump price. 

    7.4 7-Eleven may refuse to process a barcode if it is affected by an error by the App or if 7-Eleven or EnergyAustralia acting reasonably suspect misuse of the barcode or the App.

    7.5 You may receive an error message in the App if you attempt to generate a barcode while overseas.
     

  8. Suspension, ending the Offer, and termination

    8.1 We may suspend your access to the Offer (including your ability to generate a barcode) where we reasonably consider it necessary to:

    (a) address fraud, security issues or suspected misuse of your profile, the App or Barcode(s); or

    (b) protect the security of our systems or the integrity of the Offer.

    8.2 We may terminate these Terms immediately where:

    (a) you have breached a material term of these Terms and have not rectified that breach within 14 days of receiving a written notice from us;

    (b) you no longer satisfy any one or more of the Eligibility Criteria; or

    (c) your EnergyAustralia Retail Contract terminates or expires for any reason; or

    (d) the 7‑Eleven partnership arrangements or the relevant 7‑Eleven systems required to provide the Offer are suspended or cease, and as a result we can no longer reasonably provide the Offer.

    8.3 We may end the Offer (and terminate these Terms) by giving you at least 30 days’ prior written notice where we reasonably consider it necessary to:

    (a) comply with applicable law or regulator requirements; or

    (b) respond to the cessation, suspension or material change of the 7‑Eleven partnership arrangements or relevant 7‑Eleven systems required to provide the Offer.

    8.4 If we end the Offer under clause 8.3, we will honour any Barcode that you generated before the end date stated in our notice for the remainder of its validity period (see clause 7.2).

    8.5 Ending the Offer or terminating these Terms affects only your access to the Offer. It does not affect your EnergyAustralia Retail Contract.

    8.6 Either you or we may terminate these Terms (and your access to the Offer) for convenience at any time by giving the other at least 30 days’ notice. You may give notice by contacting us in accordance with clause 14 (Support) or clause 16.2 (Notices). We may give notice in accordance with clause 16.2 (including by notice in the App and/or on our website).

  9. Changes to the Offer or these Terms

    9.1 We may update these Terms from time to time, subject to applicable law.

    9.2 If we update these Terms, we will publish the new version on the App and/or our website.

    9.3 If we make material changes to the Terms, we will take reasonable steps to notify you of the change (for example, by notification in the App, on our website, or by other reasonable means) before the change takes effect.

  10. Fuel purchase is with 7‑Eleven

    10.1 The Offer is a discount applied to the price of fuel you purchase at 7-Eleven Fuel Stores. Your purchase of fuel is a separate transaction between you and 7‑Eleven.

    10.2 To the extent permitted by law, EnergyAustralia is not responsible for fuel quality, availability, pricing at the pump (other than the application of the Offer when validly redeemed), or any goods or services supplied by 7‑Eleven.

  11. Privacy 

    11.1 We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our privacy policy and credit information statement.

    11.2 The Offer is delivered using systems operated by EnergyAustralia and 7‑Eleven. Depending on how the Offer is delivered, information may be exchanged between those systems to generate and validate Barcodes and apply the discount.

  12. Warranties 

    12.1 There are a range of factors outside our control that may impact your ability to access or redeem the Offer, including malfunction in your device, operating system, or network connection, internet access difficulties, delay or failure of transmission, routine maintenance, or a failure of a third‑party service provider or system. This includes systems used to generate, validate, transmit or process a barcode and apply the discount at point of sale, including systems operated by 7‑Eleven. Accordingly, subject to your rights under Non‑Excludable Obligations, we do not warrant or represent that the Offer, My Account or the App will be continuously available, uninterrupted, secure or free from errors, omissions, programming bugs or viruses, or that any defects will be corrected.

    12.2 The Offer is a discount applied to fuel purchased at 7-Eleven Fuel Stores. Your purchase of fuel (including fuel quality, fuel availability and the point of sale transaction) is a separate transaction between you and 7 Eleven (or the relevant site operator), and the discount is Applied using 7 Eleven systems when a valid Barcode is presented and accepted. We do not provide the fuel and we are not a party to that fuel purchase transaction. Subject to your rights under Non Excludable Obligations, we make no warranty or representation in relation to the fuel or any goods or services supplied by 7 Eleven, or the availability of 7-Eleven Fuel Stores.

    12.3 There may be other non‑excludable statutory guarantees, implied conditions or warranties including under consumer protection laws that cannot be excluded (Non‑Excludable Obligations) which may apply to the services we provide under these Terms (including enabling you to generate and access a Barcode in the App/My Account). Nothing in these Terms excludes, restricts or modifies any Non‑Excludable Obligations.

    12.4 If Non‑Excludable Obligations apply and there is a major failure with the services we provide under these Terms, you are entitled to cancel these Terms and to a refund for the unused portion, or to compensation for its reduced value (where applicable). You are also entitled to be compensated for any other reasonably foreseeable Loss.

    12.5 If Non‑Excludable Obligations apply and the failure does not amount to a major failure, you are entitled to have problems with the services rectified in a reasonable time and, if this is not done, to cancel these Terms and obtain a refund for the unused portion of these Terms (where applicable).

    12.6 For clarity, clauses 12.3-12.5 relate only to the services we provide under these Terms (including Barcode generation/access). They do not relate to fuel or other goods or services supplied by 7‑Eleven, which are the subject of a separate transaction between you and 7‑Eleven.

  13. Liability

    13.1 Except in relation to:

    (a) our Non‑Excludable Obligations;

    (b) our breach of these Terms; and

    (c) our negligent acts or omissions,

    to the extent permitted by law, we are not liable to you for any Loss, including any indirect or consequential Loss, arising directly or indirectly under or in connection with these Terms, the Offer, My Account, or the App (including where you are unable to generate, access or use a Barcode, or where the Offer is unavailable or cannot be redeemed), whether arising under any indemnity, statute, in tort (for negligence or otherwise), or on any other basis in law or equity.

    13.2 Without limiting clause 13.1, we are not liable to you in relation to any matter that is part of, or arises from, your fuel purchase transaction with 7‑Eleven (or the relevant site operator), including:

    (a) fuel quality or fuel availability;

    (b) whether a particular 7-Eleven Fuel Stores is operational or participates in the Offer;

    (c) any failure, delay or unavailability of 7‑Eleven point of sale systems or other 7‑Eleven systems required to validate or apply the discount; or

    (d) any act or omission of 7‑Eleven (including any refusal to process a barcode),

    except to the extent that the Loss is caused by our breach of these Terms or our negligent acts or omissions, or cannot be excluded under our Non‑Excludable Obligation.

  14. Support 

    14.1 If you require any help or support in relation to the services you should contact us at 133 466. 

  15. Governing law 

    15.1 This agreement is governed by the laws of Victoria, Australia.  By using this service, you submit to the exclusive jurisdiction of the courts in Victoria. 

  16. General

    16.1 Variation and waiver

    (a) Any waiver by us of any right under these Terms must be in writing to be effective.

    (b) Our failure or delay to exercise a right does not operate as a waiver of that right.

    16.2 Notices

    (a) We may give you notices or other communications in relation to the Offer or these Terms by any reasonable means, including by notice in the App, on our website, by email, SMS, push notification, or post.

    (b) You may give us notices in relation to these Terms by contacting us via the contact details in clause 14 (Support) or via the contact channels set out on our website.

    16.3 Dispute resolution

    (a) If you have a complaint or dispute in relation to the Offer or these Terms, please contact us first and we will try to resolve it in good faith.

    (b) Nothing in these Terms limits your rights under any Non-Excludable Obligations or prevents you from seeking external assistance or remedies where permitted by law.

    (c) For disputes relating to your fuel purchase (including fuel quality, fuel availability, or point of sale issues), your dispute is with 7‑Eleven (or the relevant site operator) under clause 10.

    16.4 Assignment / novation

    (a) We may assign or novate our rights and obligations under these Terms to an affiliate or a successor entity (for example, due to a restructure or sale), and we will take reasonable steps to notify you if this occurs where required by law.

    (b) You must not assign or transfer your rights or obligations under these Terms.

    16.5 Entire agreement

    These Terms, together with the Platform Terms (and any documents or policies referenced in them, including our privacy policy and credit information statement), constitute the entire agreement between you and us in relation to the Offer, and supersede any prior discussions or representations relating to the Offer.

    16.6 Severability

    If any provision of these Terms is invalid or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will remain in full force and effect.

    16.7 Unsolicited consumer agreement

    You acknowledge that participation in the Offer is optional and is accessed by you through the App. These Terms are not intended to constitute an unsolicited consumer agreement for the purposes of the Australian Consumer Law.
     

17. Definitions 

In these Terms, the following terms have the meaning set out below. 

AdBlue’ means diesel exhaust fluid marketed as AdBlue and sold by 7‑Eleven.

Appmeans the EnergyAustralia mobile Application.

Barcode’ means the discount barcode generated in the App for the Offer.

Effective Date’ means the effective date stated at the start of these Terms.

EnergyAustralia Retail Contract means the contract between us and you for the supply of energy to your premises.

7-Eleven Fuel Stores means fuel sites operated by 7Eleven in Australia from time to time at which the Offer can be redeemed.

‘Loss’ means liability, loss, harm, damage, cost or expense. 

‘My Account’ means EnergyAustralia’s online account portal/service.

Offer’ means the 6 cents per litre fuel discount available at 7Eleven Fuel Stores when redeemed by scanning a valid Barcode through the App, subject to these Terms.

Offer Period has the meaning given in clause 5.2.

Platform Terms’ means our My Account and App terms and conditions published on the App and our website.

‘We’, ‘us’, or ‘our’ means EnergyAustralia (ABN 99 086 014 968). 

‘You’ or ‘your’ means the customer accessing the Offer via the App.
