"Show your energy for the Stars" Promotion 4 (Promotion)

Terms and conditions

1. By entering the Promotion, each Entrant is taken by TRUenergy Pty Ltd ABN 99 086 014 968 (trading as EnergyAustralia) (Promoter) to accept these terms and conditions. Information on how to enter this Promotion forms part of these terms and conditions.
2. Entry into this Promotion is restricted to Victorian residents aged 18 years or over excluding any Excluded Person.
3. An Excluded Person is each employee (and any person who is an immediate family member of such an employee) of the Promoter, Cricket Australia or Melbourne Stars Ltd.
4. To enter the Promotion, an eligible person (Entrant) must enter their details into and submit the online entry form accessible at http://www.energyaustralia.com.au/cricketcomp prior to 5pm AEDT on 31 January 2012. A person may not enter the Promotion more than once.
5. The winner of the Promotion (Winner) will be the Entrant randomly drawn by the Promoter from all Entrants. The draw to determine the Winner will be held at 10am AEDT on 1 February 2012 at Level 23, 535 Bourke Street, Melbourne.
6. The Winner will be notified in writing as soon as practicable after the draw is concluded. The details of the Winner will be published in The Age newspaper on 6 February 2012.
7. The Winner will receive (a) if they are an existing customer for the supply of electricity by the Promoter at date of the draw, an offer to credit the Winner’s existing account with the Promoter with AUD$1,000; or (b) in any other case, an offer from the Promoter to enter into the Promotional Energy Agreement.
8. The Promotional Energy Agreement will be an agreement for the supply of electricity to a private residence located in Victoria, based on the terms of the Promoter’s Energy Australia Standing Energy Agreement, the account for which will be credited by the Promoter with an amount equal to AUD$1,000 (less any connection fees or other fees payable in relation to the transfer of the Winner’s electricity supply account to the Promoter) once the relevant cooling off period expires. The full terms and conditions of the Promotional Energy Agreement (including instructions on how to accept that offer) will be provided to the Winner in writing together with the notification referred to in clause 6.
9. If the Winner does not accept the offer to enter into the Promotional Energy Agreement (if applicable) within 14 days of receipt of the notification referred to in clause 6, then that offer will lapse, will be of no further effect and will no longer be capable of acceptance. The Winner will not be entitled to any other prize in lieu of the offer to enter into the Promotional Energy Agreement. No prize, or any unused portion of the prize, is exchangeable or redeemable for cash.
10. The Promoter reserves the right, unless to do so would be prohibited by law, to cancel, suspend, modify, terminate or cancel the Promotion.
11. To the maximum extent permitted by law, the Promoter excludes from these terms and conditions all conditions, warranties and terms, implied by statute, general law or custom and the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any loss or damage whether direct, indirect, special or consequential, arising in any way out of the Promotion.
12. The Winner consents to the Promoter using (or permitting authorised third parties to use) his or her name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome). The Promoter collects personal information in order to conduct the promotion and provide any goods/services requested and may, for that purpose, disclose such information to third parties, including, but not limited to, prize suppliers or a regulatory authority and for any purpose to which the entrant has previously consented, including but not limited to, future promotional, marketing and publicity purposes. The Winner should direct any request to access, update or correct his or her personal information to the Promoter.
